Apply for a Child Arrangement Order

If you want to apply to Court or seek advice about contact with a child, where a child lives, or any other application involving a child, we have fixed fees at various levels for you.

The below stages provide an indication of what is included in each of the different parts of the process.

Stage 1 - Pre-Court Proceedings/Negotiations

​

£300 plus VAT - The price does not include any disbursements payable.

What's included

​​

  • An initial interview

  • Sending out detailed client care letter setting out instructions, advice and what we will do for you.

  • Sending correspondence to the other party or their representatives.

  • If necessary, we will refer your case to the Mediation Service. The Mediation Service charges a separate fee for the Form required to issue Court Proceedings.

  • A letter confirming the outcome of the mediation or correspondence with the opposing party, as well as advice on how to proceed or end the matter.

What's not included

​​

  • Any additional charges or disbursements, such as but not limited to interpreter fees and translation documents.

  • Any unforeseen circumstances that require additional work, such as lengthy negotiations or letters, or complicated concerns. If this happens, we'll let you know.

Stage 2 - Application to court and representations at the First Court Hearing

​

Stage 1 fee and additional £600 plus VAT - The price does not include any disbursements payable.

What's included

​​

  • Preparation of the court application and submission to the court after your approval.

  • Issuing the proceedings at Court and serving the other party with the relevant documents.

  • Providing you with advice and representation at the Court hearing on the first appointment, including negotiating with the other party or their solicitor, discussing matters with CAFCASS, and representing you before the Court. 

  • Sending you correspondence following the Court hearing confirming the outcome of the hearing.

What's not included

​​

  • Any additional charges or disbursements, such as but not limited to interpreter fees and translation documents.

  • Representation at any adjourned review, directions or other hearing.

  • Any implementation of the Order.

  • Any unforeseen circumstances that require additional work, such as lengthy negotiations or letters, or complicated concerns. If this happens, we'll let you know.

Only one review or directions hearing is included in this fixed fee for Level 2. If you need representation at any further hearings then a further additional payment of £400 plus VAT of £80 = £480 will be charged for each additional hearing

Stage 3 - Representations following the first hearing or up to the final hearing

 

£750 plus VAT - The price does not include any disbursements payable.

What's included

​​

  • Preparation of documents following the directions from the first hearing, which
    may include preparing a statement or reviewing a CAFCASS or other expert reports

  • Obtaining additional evidence from other sources which may benefit your matter

  • Corresponding with you regularly to inform you regarding the progress of your case.

  • Representing you at one further review or directions hearing (not to include a final or contested hearing)

What's not included

​​

  • Any additional charges or disbursements, such as but not limited to interpreter fees and translation documents.

  • Any unforeseen circumstances that require additional work, such as lengthy negotiations or letters, or complicated concerns. If this happens, we'll let you know.

Only one review or directions hearing is included in this fixed fee. If you need representation at any further hearings then a further additional payment of £400 plus VAT of £80 = £480 will be charged for each additional hearing.

Stage 4 - Preparations up to a final hearing but not including representation at that hearing

​

£1000 plus VAT - The price does not include any disbursements payable.

What's included

​​

  • Corresponding and advising you regarding the progress of your case.

  • Obtaining quotes for barristers and instructing your preferred barrister to represent you at a final hearing. â€‹â€‹

  • Providing instructions to barrister and providing additional documents as necessary.

  • Preparing documents for the final hearing including case summary, chronology, statement of issues and the bundle to the Court.

What's not included

​​

  • Any additional charges or disbursements, such as but not limited to interpreter fees and translation documents.

  • Any unforeseen circumstances that require additional work, such as lengthy negotiations or letters, or complicated concerns. If this happens, we'll let you know.

  • Barrister fee for representation at the hearing.

What's included

​​

  • Representation at Court for each day of the court. 

  • Providing you with a detailed explanation of the outcome of the hearing to you.

  • Reviewing the Order to ensure it is correct.

What's not included

​​

  • Any additional charges or disbursements, such as but not limited to interpreter fees and translation documents.

  • Any unforeseen circumstances that require additional work, such as lengthy negotiations or letters, or complicated concerns. If this happens, we'll let you know.

  • Any further hearings following the final hearing. Further information can be provided for this if required.

  • Implementation or enforcement of the Order.

  • Barrister fee for representation at the hearing.

Stage 5 - Representation at Court by a qualified barrister at the final hearing

Fee for the barrister will be payable separately upfront and subject to VAT. Fee to be discussed prior to instructing.

If there are any unforeseen circumstances that occur during your case we will be able to discuss with you the action required and the cost involved. In all instances, we will provide you with a variety of options on how to resolve your issue and will not take any action without your clear instructions.
